Definitions

1.Feeling Good Acai is a trade name of Feeling Good Juices in The Hague and registered with the Chamber of Commerce under registration number 67890830. The registered VAT number is NL145960997B02.
2 Website: the website of Feeling Good Acai, which can be consulted via www.feelinggoodacai.com and all associated subdomains.
3 Customer: the natural or legal person, whether or not acting in a professional or company capacity that enters into an Agreement with Feeling Good Acai Feeling Good Acai and / or has registered on the Website.
4 Agreement: every agreement or agreement between Feeling Good Acai and the Customer, of which agreement the General Terms and Conditions form an integral part.

Applicability of the General Terms and Conditions
1 The General Terms and Conditions apply to all offers, agreements and deliveries of Feeling Good Acai, unless explicitly agreed otherwise in writing.
2 If the Customer includes provisions or conditions that deviate from, or do not appear in, the General Terms and Conditions in its order, confirmation or communication, which are different from or do not appear in the General Terms and Conditions, these are only binding on Feeling Good Acai if and insofar as they have been explicitly accepted in writing by Feeling Good Acai. .
3 In the event that specific product or service conditions apply in addition to these General Terms and Conditions, those terms and conditions also apply, but in the event of conflicting terms and conditions, the Customer may always invoke the applicable provision that is most favorable to him. 

Prices and information
1 All prices stated on the Website and in other materials originating from Feeling Good Acai include VAT and, unless otherwise stated on the Website, other levies imposed by the government.
2 If shipping costs are charged, this will be clearly stated in time for the conclusion of the Agreement. In addition, these costs will be shown separately in the ordering process.
3 The content of the Website has been compiled with the greatest care. However, Feeling Good Acai cannot guarantee that all information on the website is accurate and complete at all times. All prices and other information on the Website and in other materials from Feeling Good Acai are therefore subject to obvious programming and typing errors.
4 Feeling Good Acai cannot be held responsible for (color) deviations due to screen quality.

Establishment of the Agreement
1 The Agreement is concluded at the moment of acceptance by the Customer of the offer from Feeling Good Acai and compliance with the terms and conditions set by Feeling Good Acai.
2 If the Customer has accepted the offer electronically, Feeling Good Acai will immediately confirm receipt of the acceptance of the offer electronically. As long as the receipt of this acceptance has not been confirmed, the Client has the option to terminate the Agreement.
3 If it appears that incorrect information was provided by the Customer when accepting or otherwise entering into the Agreement, Feeling Good Acai has the right to fulfill its obligation only after the correct information has been received.
4 Feeling Good Acai can inform itself within legal frameworks whether the Customer can meet its payment obligations, but also of all facts and factors that are important for a responsible conclusion of the Agreement. If, based on this investigation, Feeling Good Acai has good reasons not to enter into the Agreement, it is entitled to refuse an order or request, or to attach special conditions, such as advance payment, to the implementation.

Registration
1 In order to make optimum use of the Website, the Client can register via the registration form / the account registration option on the Website.
2 During the registration procedure, the Client chooses a username and password with which he can log in to the Website after registration. Customer is responsible for choosing a sufficiently reliable password.
3 The customer must keep his login details, username and password strictly confidential. Feeling Good Acai is not liable for misuse of the login data and may always assume that a Customer who logs on to the Website is actually that Customer. Everything that happens via the account of the Customer falls under the responsibility and risk of the Customer.
4 If the Customer knows or suspects that his log-in data has fallen into the hands of unauthorized persons, he must change his password as soon as possible and / or inform Feeling Good Acai accordingly, so that Feeling Good Acai can take appropriate measures.

Execution Agreement
1 As soon as the order has been received by Feeling Good Acai, Feeling Good Acai will send the products as soon as possible with due observance of the provisions of paragraph 3 of this Article.
2 Feeling Good Acai is entitled to engage third parties to perform the obligations arising from the Agreement.
3 The Website clearly describes, in time for the conclusion of the Agreement, the manner in which delivery will take place and the period within which the products will be delivered. If no delivery time has been agreed or stated, then products will in any case be delivered within 30 days.
4 If Feeling Good Acai cannot deliver the products within the agreed period, it will inform the Customer thereof. In that case, the customer can agree to a new delivery date or he will be given the option to terminate the Agreement free of charge.
5 Feeling Good Acai advises the Customer to inspect the products supplied and to report any defects found within a reasonable time, preferably in writing or by e-mail. See further the Article regarding warranty and conformity.
6 As soon as the products to be delivered have been delivered to the specified delivery address, the risk with regard to these products is transferred to the Customer. If explicitly agreed otherwise, the risk is transferred to the Customer earlier. If the Customer decides to collect the products, the risk passes when the products are transferred.
7 Feeling Good Acai is entitled to deliver a similar product of similar quality as the ordered product, if the ordered is no longer available. The customer is then entitled to terminate the agreement free of charge and to return the product free of charge. 

Right of withdrawal / return
1 This article only applies if the Client is a natural person who is not acting in the exercise of his profession or business. Business Customers are therefore not entitled to a right of withdrawal. Customer has the right to terminate the agreement with Feeling Good Acai concluded at a distance within 14 calendar days after receipt of the product, without giving reasons, free of charge. The period starts on the day after the Customer, or a third party designated by him in advance, who is not the carrier, has received the product, or:

– if the Customer has ordered several products in the same order: the day on which the Customer, or a third party designated by him, has received the last product;

– if the delivery of a product consists of several shipments or parts: the day on which the Customer, or a third party designated by him, has received the last shipment or part;

– for agreements for regular delivery of products during a certain period: the day on which the Customer, or a third party designated by him, has received the first product.

2 When returning, only the costs for the return will be charged.
3 Within the withdrawal period referred to in paragraph 1, the Client will handle the product and the packaging with care. The customer will only open the package and use the product only to the extent necessary to ascertain the nature, characteristics and operation of products. The starting point here is that this inspection may not go beyond what the Customer could do in a physical store.
4 The customer is only liable for value reduction of the product that is the result of a way of handling the product that goes beyond what is permitted in the previous paragraph.
5 The Customer can terminate the Agreement in accordance with paragraph 1 of the period set in this Article by sending the model form for withdrawal (digitally) to Feeling Good Acai, or by making it clear to Feeling Good Acai in another way that he will cancel the purchase. . Feeling Good Acai confirms receipt of that notification in the event of a digital report. After dissolution, the Client still has 14 days to return the product. It is also possible to immediately return the product within the cooling-off period specified in paragraph 1 of this Article, provided that the model withdrawal form or other unambiguous withdrawal statement is included.

6 Amounts (already paid in advance) by the Customer will be reimbursed to the Customer as soon as possible, but no later than within 14 days after the termination of the Agreement, in the same way that the Customer has paid for the order.
Unless Feeling Good Acai offers to collect the product itself, Feeling Good Acai may wait to refund until Feeling Good Acai has received the product or until Customer demonstrates that it has returned the product, whichever is the earlier.
7 On the Website, information about whether or not the right of withdrawal is applicable and any desired procedure is stated in a timely manner before the conclusion of the Agreement.

Payment
1 The customer must make payments to Feeling Good Acai according to the payment methods indicated in the order procedure and possibly on the Website. Feeling Good Acai is free in the choice of offering payment methods and these may also change from time to time. In the event of payment after delivery, the Client has a payment period of 14 days starting on the day after delivery.

Warranty and conformity
1 This article only applies if there is a Customer who is not acting in the exercise of his profession or business. If a separate guarantee is given by Feeling Good Acai on the products, this applies to all types of Customers, without prejudice to the just stated.
2 Feeling Good Acai guarantees that the products comply with the Agreement, the specifications stated in the offer, the reasonable requirements of reliability and / or usability and the legal provisions and / or existing legal provisions on the date of the conclusion of the agreement. government regulations. If specifically agreed, Feeling Good Acai also guarantees that the product is suitable for other than normal use.
3 A guarantee provided by Feeling Good Acai, manufacturer or importer does not affect the legal rights and claims that the Customer already has and can invoke under the Agreement.
4 If the delivered product does not comply with the Agreement, the Client must inform Feeling Good Acai within a reasonable period of time after it has discovered the defect.
5 If Feeling Good Acai considers the complaint to be justified, the relevant products will be repaired, replaced or reimbursed after consultation with the Customer. With due observance of the Article on liability, the maximum reimbursement is equal to the price paid by the Customer for the product. 

Complaints procedure
1 If the Customer has a complaint about a product (in accordance with Article regarding warranty and conformity) and / or about other aspects of the services of Feeling Good Acai, he can contact The Feeling Good Acai by telephone, e-mail or post. to file a complaint. See the contact details at the bottom of the Terms and Conditions.
2 Feeling Good Acai gives the Client a response to his complaint as soon as possible, but in any case within 2 working days of receiving the complaint. If it is not yet possible to give a substantive or definitive response, then Feeling Good Acai will confirm within 2 working days of receiving the complaint and give an indication of the period within which it expects to give a substantive or definitive response to the complaint from Customer.

Liability
1 This Article only applies if the Client is a natural or legal person who is acting in the exercise of his profession or business.
2 The total liability of Feeling Good Acai vis-à-vis the Customer for attributable failure to comply with the Agreement is limited to reimbursement of a maximum of the amount stipulated for that Agreement (including VAT).
3 Liability of Feeling Good Acai vis-à-vis the Customer for indirect damage, including in any case – but explicitly not exclusively – consequential damage, lost profit, lost savings, loss of data and damage due to business interruption is excluded.
4 Apart from the cases mentioned in the previous two paragraphs of this Article, Feeling Good Acai is not liable to the Client for any compensation whatsoever, regardless of the grounds on which an action for compensation would be based. The limitations referred to in this Article will, however, lapse if and insofar as damage is the result of intent or gross negligence on the part of Feeling Good Acai.
5 The liability of Feeling Good Acai vis-à-vis the Customer for attributable shortcoming in the performance of an agreement arises only if the Customer gives Feeling Good Acai immediate and proper written notice of default, thereby stipulating a reasonable period of time to clear the shortcoming, and Feeling Good Acai also after that continues to fall short in fulfilling its obligations. The notice of default must contain as detailed a description as possible of the shortcoming, so that Feeling Good Acai is able to respond adequately.
6 A condition for the existence of any right to compensation is always that the Customer reports the damage in writing to Feeling Good Acai as soon as possible, but at the latest within 30 days after its occurrence.
7 In the event of force majeure, Feeling Good Acai is not obliged to compensate for any damage caused thereby to the Customer.

Personal data
1 Feeling Good Acai processes the personal data of the Customer in accordance with the privacy statement published on the Website.

Final provisions
1 The Agreement is governed by Dutch law.
2 Unless otherwise provided by mandatory law, all disputes that may arise under the Agreement will be submitted to the competent Dutch court in the district where Feeling Good Acai is located.
3 If a provision in these General Terms and Conditions turns out to be invalid, this does not affect the validity of the entire General Terms and Conditions. The parties will in that case replace (a) new provision (s), which will give shape to the intention of the original provision as much as possible in law.
4 In these General Terms and Conditions, “written” also means communication by e-mail and fax, provided that the identity of the sender and the integrity of the e-mail are sufficiently established.
